Terms and Conditions of Sale

Article 1 — Purpose

These Terms and Conditions of Sale (hereinafter the "T&C") apply to all sales of used military vehicles, trailers, spare parts and other equipment made by Lys Tout Terrain, whose registered office is located at ZA du Luxembourg, 62129 Thérouanne, France (hereinafter the "Seller"), to any professional or private buyer (hereinafter the "Buyer").

Any order or purchase implies unreserved acceptance of these T&C by the Buyer.

Article 2 — Prices

Prices are expressed in euros (€) excluding tax (HT) and inclusive of tax (TTC) as applicable. They are indicative and may be amended without notice. Only the price shown on the invoice or signed purchase order is binding.

For export sales (outside the EU), French VAT does not apply subject to the provision of the required export documents.

Prices do not include transport, insurance, customs clearance or other ancillary costs, unless explicitly stated otherwise in the purchase order.

Article 3 — Payment terms

Unless otherwise agreed in writing, payment is made as follows:

  • Deposit: 30% to 50% of the total price at the time of order
  • Balance: before collection or before shipment of the vehicle
  • Accepted methods: SEPA or international bank transfer (SWIFT), bank cheque

The Seller reserves the right to require full payment before shipment for any export sale or for any new Buyer.

Article 4 — Retention of title

The Seller retains full ownership of the goods sold until full payment of the principal, interest and costs. In the event of non-payment, the Seller may demand the immediate return of the goods at the Buyer's cost and risk.

Article 5 — Delivery and transfer of risk

Vehicles are sold under the Incoterm agreed in the purchase order (EXW, FOB, CIF or other). If no Incoterm is specified, the sale is deemed to be EXW (ex-works Thérouanne).

The transfer of risk of loss and deterioration takes place in accordance with the applicable Incoterm. Under EXW, risk passes to the Buyer as soon as the goods are made available at the Seller's premises.

Article 6 — Condition of vehicles — Sold as-is

The vehicles sold are used vehicles. They are sold as-is, as described in the technical sheets and listings.

Indicative nature of catalogue data. The catalogue on the website is for general information. The vehicle sheets present a model of which the Seller may hold several identical or very similar units in stock. Accordingly:

  • The displayed mileage is indicative and non-contractual: it may vary from one unit to another, within the usual range for vehicles of the same series.
  • The photographs show the model and are non-contractual. The unit actually delivered may show minor variations (paint, original accessories, optional equipment, traces of use).
  • The technical specifications shown(power, dimensions, emission standard, etc.) reflect the manufacturer's specifications of the model. The Seller strives to keep them up to date but does not guarantee their completeness before a specific unit is assigned.

Confirmation of the unit sold. The vehicle actually assigned to the Buyer — identified by its chassis number, its exact recorded mileage and photographs of its precise condition — is confirmed at the time of order, in the purchase order accepted by both parties. These elements alone are binding between the parties.

The Buyer is invited to inspect vehicles prior to purchase. Visits are possible by appointment at our warehouses in Thérouanne. Failing a visit, the Buyer acknowledges having reviewed the written and photographic description of the assigned vehicle, as confirmed in the purchase order.

In accordance with Article 1641 of the French Civil Code, the Seller is liable for hidden defects rendering the goods unfit for their intended use, provided that the Buyer proves these defects existed at the time of sale and were unknown to them.

Article 7 — Legal warranty

For sales to private individuals (consumers within the meaning of the French Consumer Code), the 2-year legal warranty of conformity applies, reduced to 1 year for used goods in accordance with Article L. 217-9 of the Consumer Code.

For business-to-business sales, no warranty other than the legal warranty against hidden defects is granted, unless explicitly stated otherwise on the purchase order.

Article 8 — Export liability

The Buyer exports under their own responsibility and undertakes to comply with all regulations of the destination country. The Seller cannot be held liable for taxes, fines, confiscations or other consequences related to the Buyer's failure to comply with local import regulations.

The Buyer declares that the goods acquired will not be used for purposes contrary to international embargoes in force and undertakes not to re-export them to embargoed countries.

Article 9 — Applicable law and disputes

These T&C are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing that, the Commercial Court of Boulogne-sur-Mer shall have sole jurisdiction, save for any mandatory legal provision to the contrary.
